A company based out of Cheyenne, Wyoming, named Enhanced Athlete, has managed to convince an Eastern District of California, District Court judge, to denounce an injunction that was brought forward by Nutrition Distribution, who were the plaintiffs in the case. The case was concerning false advertisement claims by the former. Enhanced Athlete is a bodybuilding and fitness supplements company that was started with the idea to help humans become superhuman. Enhanced Athlete is just one of the companies that Nutrition Distribution has brought a case against. Nutrition Distribution has filed over seventy lawsuits, as well as a few hundred desist letters, drawn up by their attorneys, requiring that a substantial financial settlement is paid. Nutrition Distribution, LLC v. Enhanced Athlete, Inc. et al. (E.D. Cal., Case N. 2:17-cv-2069-JAM-CKD) During every case that Nutrition Distribution has brought against their defendants, they have claimed that they are in the forefront and leaders in the supplemental industry. They argue that the amount of sales that they have has decreased and was damaged by false advertisement of said companies in the cases.
In Enhanced Athlete answer to the plaintiff’s statements they said Nutrition Distribution is not in business to make money through the sale of supplements, instead, they are into badgering other companies trying to force them to pay a substantial amount of cash to deal with the issue. If said company does not do so then Nutrition Distribution will, in turn, bring a case against the company, which will cost an exorbitant amount in legal fees and time. Enhanced Athlete also contended that Nutrition Distribution had not validated the statements of before mentioned loss in revenue. Enhanced Athlete believes the reason for this is because there has never been a connection between the two.
The Court agreed with the Defendant that there was not proper evidence of a connection between the marketing and a decrease in Nutrition Distribution sales. The CEO of Enhanced Athlete has stated, that they will not be next in line to fall victim to the coercing schemes of Nutrition Distributions, if companies continue to pay the sums that Nutrition Distribution is asking for then they will continue to do so. Enhanced Athlete’s sister companies, Enhanced Gear and Enhanced Coaching weren’t included in the lawsuit. Enhanced Gear provides merchandise for Enhanced Athlete’s customers; while Enhanced Coaching was created to provide a necessary service and access to Enhanced Coaching coaches; that the normal consumer wouldn’t have contact with.
